The balance is payable no later than 60 days prior to departure. CANCELLATION: The non-refundable 20% deposit is forfeited on cancellation. Cancellations within 60 days of departure will forfeit the total amount of the booking. Where a passenger(s) does not arrive and no cancellation has been received, then the total value of the booking is forfeited to Opal Shell Yacht Charters. If circumstances require Opal Shell Yacht Charters to cancel a cruise, as much notice as possible will be given. No liability, however, will fall on Opal Shell yacht Charters for any expenses incurred as a result of the cruise cancellation save the refunding of monies already paid towards that cruise. INSURANCE: Opal Shell Yacht Charters is not liable for loss of, or damage to, baggage and personal property. It is recommended that comprehensive travel insurance, including cancellation cover and evacuation insurance, be taken out at the time of the initial booking. LIABILITY: It is expected that all passengers are aware that due to the conditions in and the remoteness of the Kimberley region, they at some point during the cruise may face physical discomfort and the possibility of danger and accept this as the nature of the cruise. The cruise schedule may be altered due to weather conditions. Opal Shell Yacht Charters undertake to provide all due care during the cruise and provide every possible safety precaution but the ultimate responsibility for illness, accident or death, or any property damage or loss, including valuables, lies with the passenger. Opal Shell Yacht Charters are not responsible for other carriers whose actions may result in passengers failing to meet the conditions set down for any Opal Shell cruise.
